How the hell are torrent sites like oink not illegal?

They are still technically illegal. I see that some individuals have been prosecuted for simply DL-ing from such sites, but I believe they are a rarity. Its mainly the providers or sites themselves that are bearing the real risk.

I am a lawyer, but this isn't the area I practice, and I am not very good anyway.

Oink gets around alot because A) it's based in the UK. Piratesbay.org is based in Sweden and from the notices that guy posts, it seems that International Law is kinda funny or at least complicates the copyright infringement issues. So maybe being in the UK, Oink is able to skirt some of the more typical entanglements. Also because it's invite-only, Oink enables to help prevent a lot of lurkers from getting access to see what's up there. I think those two issues off the bat help to prevent 90% of the legal retributions that shut similar torrent sites down. Honestly, I think it's only a matter of time before Oink gets it.

i think oink itself is legal, simply the filesharing concept, but when the copyrighted material is shared, it's not.

only a 2l. but my understanding is that making copies of anything, for anyone, is pretty much fine, as long as you dont sell copyrighted materials. now, making available to copy seems an unresolved issue. we know how the record companies want this to go. see the xm suit currently happening. the record companies should fuck off. just becuase they havent made a cent over the last few years does not meant they should be able to change the laws drastically.

anyone should be permitted to copy anything to give and use as long as its not sold. record companies need to sack up and work on enforcement, rather than trying to change precedent.

I think that you might be right about Oink or any other sites because Pirate Bay has been shut down.

i have no clue but the site pulls me in different directions one yeah i can get stuff for free which the word FREE always sounds good to someone broke as i am but after a download i do feel dirty
there are so many torrent sites and the internet is just geting faster and faster and hard drives are geting out of this world in size i have no clue how anybody makes any money at all in music.

I download tons from Oink. I buy tons of albums. My conscience is at ease.

Artists make most of their money touring.
