So I was coming home from work this evening. I have a 5 minutes drive and it's all in urban roads. I'm cruising at 50 km/h, part dreaming, part watching the road and the rearviewmirror. Suddenly, out of nowhere a motorcycle comes and crashes into the back of my car !
The man was riding at no less than 80 km/h. At the moment I saw him in my rvm, I thought : "what the f... ???!!??" and simultaneously, I heard the sound of the crash and my rear windshield going into pieces.
I stopped my car about 60/70 meters away and hurried back to see what happened to the motorcycle driver. Well, to be frank, I'm much better now than he is : basically he has a severe leg injury (broken bone and open wound) multiple scratches over the head.
I'm quite shocked, I've done nothing wrong regarding my driving, the cops that were called gave me the alcohol test which was evidently negative (as i was coming from work). Here is the result of the crash

I'm perfectly fine on a physical level, quite shocked on a psychological level and i really dont know what is going to happen next cause the motorcycle drive is in the hospital, doesnt have a driver license and wasn't riding his own bike who hopefully is insured.
I think I'm gong to be in quite a mess for the next weeks concerning this shit...

Clearly, you should have been driving much faster.

That's crazy. One time I was leaving a gas station and I got a phone call so I stopped at the exit to take the call, and a second later a guy on a bike ran the light right before the station. If I hadn't have gotten the call and had pulled out he would have probably killed us both, as he had to have been going at least 90.

This. Also, sorry man. That story is horrible.

The important part is you are o.k.

I think it's standard procedure.

But even if he was drunk, how could he make the guy crash into his rear?

:haha:

You don't seem to understand "standard procedure", plus if he was drunk, he had no business being on the road.

Yes it's standard procedure here in France : if I was drunk, the guy will still be crashing my car but my insurance company will by no way pay for the damages on my car because of my drunkness and therefore inability to drive a car.
The biker had lost conscience so the police could not get him to be tested in the standard "balloon-inflating" way but i guess that the guy must have had all sort of blood test in the hospital. If he was to be found to be riding under influence, well, the things are going to be pretty rough for him.
Anyway, I thank all of you for your kind words. I hope that this shit is going to be solved in a cool an neat way for me ie I wont have to pay a dime for the damages on my car. In the worst case, i'll have to pay 170 € (which is quite cheap regarding the cost of the damages)

It may be standard procedure but it still pretty stupid.

Also I believe that given understands the concept of stadard procedure just fine and is mocking the ridiculousness of it.

This brings up a philosophical question. If someone is driving drunk, but is driving 100% OK, and then a sober guy rear ends him, who is at fault?

You're drunk, you don't drive. It's really fucking simple.

Well no shit, but that ignores the hypothetical question at hand. Does one persons wrong negate the other persons responsibility?

This question can't exist. YOU DO NOT DRIVE DRUNK. Im not getting into a debate about something like that because there will always be some smartass to say he can drive super well when intoxicated and that my friend, is bullfuckingshit.
