 Post subject: DUI's & Antidepressants

So I was pulled over last night for not coming to a complete stop at a stop sign. After seeing me, the cop asked if I had been drinking, because he thought my eyes looked bloodshot. I had not had anything to drink in the past week, and I informed him that I had just started taking Zoloft.

He comes back with the ticket and starts harassing me about the meds. He acknowledged that he could not smell any alcohol, but I did not pass his "follow the pen with your eyes test". He then said I could either call someone to pick me up, or I could take a field sobriety test, but if I failed I would be looking at a DUI. I convinced him to follow me home and said I would stay there for the night.

My question is, could he have made me take the test and if I failed, got me for a DUI? Did he have any right to tell me not to drive anywhere that night? I suspect had I drove again and he caught me, he would have made me take the field sobriety test.

It strikes me as complete BS that I go to a doctor for a legit problem, take the meds as directed, and then can get harassed by a cop because he doesn't look the way my eyes look. If this happens again should I not even mention the meds?

Yes, he can give you a DUI for prescription meds if he knows you're on them. So keep that quiet in teh future. If he suspected alcohol and you hadn't been drinking, he probably couldn't have gotten you for anything because you'd have blown clean, and he probably wouldn't look for Zoloft in any piss test or whatever they do at the station.

I have two duid's for driving on xanexes. Driving under the influence of drugs same as a duiYes I have learned the fucking hard way by being honest to a fucking cop. Luckily I got a good attorney, so it is not as extreme as it could be. My license didn't get suspended. but the judge is making me do na and i owe a shitload of money. I had weed in my system too. But yeah i iwll never tell a cop i was on medication again. No alcohol at all either time.
