As a General in the US military he committed a crime, but as the Director of CIA I'm not sure "adultery" is actually a punishable offense.

It is against the rules i think. In theory an enemy who discovered an affair could use it to blackmail him into giving away classified info, so it is kind of a big no no. Normally I'm not a fan of personal conduct clauses with jobs, but this is a little different.
