HARRISBURG, Pa. - Eight families have filed a lawsuit against a school district that is requiring students to learn about alternatives to the theory of evolution, claiming the curriculum violates the separation of church and state.
The ACLU and Americans United for Separation of Church and State said the lawsuit is the first to challenge whether public schools should teach "intelligent design," which holds that the universe is so complex that it must have been created by some higher power. The two organizations are representing the parents in the federal lawsuit.
The Dover Area School District voted 6-3 on Oct. 18 to include intelligent design in the ninth-grade science curriculum, in what is believed to be the first such requirement in the country.
The American Civil Liberties Union contends intelligent design is a more secular form of creationism _ a biblical-based view that credits the origin of species to God _ and may violate the constitutional separation of church and state.
One of the parents bringing suit, Tammy Kitzmiller, expressed concern that the school board would mandate the teaching of "something that isn't accepted as science." Kitzmiller has two children who attend Dover High School, where teachers of ninth-grade biology are expected to discuss evolution sometime next month.
School officials had no immediate comment on the lawsuit.
At least one other district has recently become embroiled in federal litigation over teaching evolution. A federal judge in Georgia is considering the constitutionality of a suburban Atlanta district's decision to include a warning sticker about evolution in biology textbooks.
Two of the three dissenting board members have resigned in protest. Angie Yingling, a board member who originally supported the policy, said she later reconsidered her vote.
"Anyone with half a brain should have known we were going to be sued," she said. "You can't do this."

Another possibility is that public schools could offer religious classes as electives, teaching the ideas and foundations without pushing the faith. I went to private Catholic school, and most (if not all) of our religion classes were taught by discussing what the faith believes in, doctrine, dogma, and history. I do not feel that at anytime were we asked to believe in it or forced to believe it (probably because it was assumed we did anyway). So, using such an example, I believe that religious classes (from a broad spectrum of religions) could be offered as electives and taught without turning into evangelical sessions and forcing a particular faith. This would allow for the teaching of ideas of each religion, including creationism, in the setting of a relgious elective. There already are religion electives and majors at public universities, and the same could be offered at public high schools and other levels as well.
Again, such a class would be a discussion of what it is, what they believe, their history, etc. I took a Judaism course in my undergrad as an elective and the instructor made it clear that the goal of the course was to discuss the religion and its practices and not to force us into becoming Jews or praying to God.
It can be done in a way which both sides of the argument are satisfied. Religion can be taught in an objective manner in public schools and those opposed to learning such things can take different electives (such as a course on Evolution for example).
So, in conclusion, we can keep science in science class and religion in religion class.

Now that's absolutely illogical. First of all, if you are for teaching creationism in schools, just come out and say it. I'm certain the majority of Americans support evolution, and don't support teaching creationism in the schools. It shouldn't even be a state's rights issue, it should be a federal issue, and the government/courts need to just say no. Creationism is a one-sided argument that favors one religions, and to learn it benefits nobody. If you want your kids to learn Creationism and can't send them to private school, teach them at home. I went to Catholic school for 8 years, and not once were we taught creationism, its baloney, pure and utter B.S. And evolution is just a theory you might say? Well should we just stop teaching the theory of gravity? What about the theory of relativity? Nothing is certain, but there is overwhelming evidence to show that evolution occurs in one form or another. Don't come on here arguing for the sake of arguing.
And back to the main topic, I'm glad the ACLU is doing something about this, its insane. Religion and politics have no business as bedfellows. I'm sure the Bush administration will do everything in their power to stop this, but I have a hard time believing majorities of judges out there really are capable of keeping Creationism in schools.

Perhaps I am missing something, but it seems to me that this is exactly what they're doing. I don't see the problem with providing alternative viewpoints and ideas to students, apparently I'm in the minority.

You don't need money to get an education in creationism. Hell you don't even need an education to get an education in creationism. Any idiot can teach it from the comfort of their own home for free. Can you afford a bible? Can your kids read? You're all set.
