Man divorces wife before claiming lotto prize

TALLAHASSEE, Florida (AP) -- It took Robert G. Swofford Jr. more than a month to come forward and claim his $60 million Lotto prize, but he had to take care of some unfinished business -- divorcing his wife.

Swofford, a postal worker from Seminole County, claimed his prize Tuesday in a $34.7 million lump sum payout, ending weeks of mystery about who won the November 24 drawing.

Swofford, 53, and his wife separated three years ago. But two weeks after the winning numbers were announced, Ann Swofford served him with divorce papers and claimed a share of the prize.

Just before Christmas, the Swoffords and their lawyers hammered out an agreement. His wife will get $5.25 million and $1 million will be set aside to support their 11-year-old son. In return, she agreed not to seek any more of Swofford's winnings.

Swofford said he remembered reading about a divorce case where a lottery winner kept it a secret and was penalized in court.

"I'd heard of a case in California where a judge heard about it after he had settled the divorce case and took the husband to the cleaners and made him pay everything he had left out of his lottery winnings," Swofford said Tuesday.

even if she is, she doesnt deserve any money from his winnings. now the kid, yes, the kid should get some money, but even so the minimum should be maybe 1000 a month for room and board etc

This sounds like a case that happened recently in Ontario I think. The guy was married with kids. I think you have like a year or something to claim the winnings? During the time that he won he divorced his wife then claimed the prize. I think she nailed him on child support though.

Oh naive Quint, you say that now because you're still with your wife and you can't imagine any feelings for her other than the ones you have now. Things change when the split happens. Normal people begin fighting over a vacuum cleaner.

You might like to think you'd be all happy happy joy joy about handing her $5 million, but reality and statistics say otherwise.

actually, you have 37.5 million, then taxes to pay after that (im not 100% sure how the whole lottery, take the lump sum, where do taxes come into play scenario)

id like to know the reasons they seperated, was she out sucking cock at the bus station every weekend night and he got sick of it?

You are taxed in the year you receive the winnings. One lump sum, one hefty tax bill. About $15 million probably went to taxes.

Yes. You are correct.


EDIT: However, he may get to deduct some of the $$$ he gave to the ex. If it is all listed as child support, then no, he can't deduct any of it. If it is listed as alimony or some other type of income splitting, then she'll have to claim it as income on her tax return.

That's the part you're missing - he will most likely still end up responsible for most of the child's serious expenses such as college and whatnot. After all, the wife only has $5 million, he has $16 million.

i didn't say parents should never divorce. my parents are divorced and it was a good thing.

i didn't say you have to be nice to the mom either, but if she's raising your kid, she should have some of your money.
