A 21-year-old man was sentenced in P.E.I. provincial court Tuesday to 15 months in jail for putting a baby in a freezer last May.
Derrick Hardy, 21, who was found guilty of assault and unlawful confinement in December, will also serve three years probation.
Handing down the sentence in Summerside court, Judge Jeff Lantz said the crime was an offence to the community.
It's lucky there weren't more serious injuries or even death," said Lantz. He also noted a marked lack of remorse on the part of Hardy, who through two hours of questioning by police never asked if the baby was all right.
The incident occurred in May. The 10-month-old baby suffered from first- and second-degree frostbite, and a bruise on the wrist from being abruptly picked up.
At the time, the baby was living with her mother and Hardy. She's now living with other relatives.
Hardy told doctors and police he put the baby in a freezer to cool down her fever.
Defence played down injuries
During the trial, witnesses testified Hardy was tired from looking after two small children alone and put the baby in the freezer out of frustration. The mother was out and came home to find the baby stuffed in the freezer with ice cubes and meat pies, wearing only a diaper and an undershirt.
Crown counsel John Diamond had asked for 12 to 18 months in jail, calling it an unconscionable breach of trust. He said Hardy acted out of "a perverted sense of discipline."
Defence attorney Robert MacNeill did not make a specific request regarding sentencing, but downplayed the baby's injuries, calling them "trivial and transient."
Hardy was also sentenced to two further months in jail on separate charges of theft. One conviction for theft of car parts stems from May 2006, and another for theft of gasoline was within the last month.

i dont see why hes in trouble, i read somewhere that in the winter when the baby is cold, he stores him in the microwave for 35 minutes under thaw 4, 18lbs and 11 ozs

people who steal gas don't generally own microwaves. i get the feeling that he is more of a boiled hotdogs kinda guy

But... but... PEI is where Anne of Green Gables comes from! This man is tarnishing Canada's only national figure.
Foreigners know more about Anne than canadians do. The only reason why most of us have even heard of her is because americans and japanese talk about her. Ive even heard of japanese tourists crying when they find out she isn't real.

I think the book is part of the Japanese curriculum. They come over here in droves to visit Lucy Maud Montgomery's birthplace.
I've never read it, but i have seen the musical in Charlottetown many many years ago. I recall hating it, but then again i never met a musical i liked.

I thought Anne was prominently featured in those patriotic Canadian commercials. At least she was prominently featured on a Canadian U-Haul trailer. What else can one provide as an example to differentiate Canada from her southern neighbor besides the numerous invasions in the period following the American Revolution?
