A Bayville couple is being sued by their neighbors because the couple’s daughters reportedly play too loudly in the couple’s backyard.

William and Rachel Poczatek’s daughters, ages 5 and 11, allegedly play too loudly when they are in the pool. They are charged with violating a noise ordinance, which is aimed at controlling the noise level of "peddlers, hawkers and vendors” whose noise could disturb “the peace and quiet of the neighborhood."

Mark Kostakis, the neighbor who made the complaint, has audio recordings of the girls playing, in order to demonstrate the amount of noise the children were making. He began his documentation after his complaints went unanswered by both the Poczateks and the village.

A Bayville code enforcement officer issued a summons to the family last month, citing the “screaming and shouting” noises that the girls were making.

However, Albert Brunetti, another neighbor of the Poczateks, has said that the children are well behaved.

The Poczateks must enter their plea today in village court. If convicted, the couple could pay up to a $250 fine, a 15-day jail sentence, or both for each day that the ordinance was violated.

If this is the Bayville on Long Island, I can see this happening there. Lots of uptight assholes living in the area. The same people probably have no problem having their lawn guys use louder than hell leaf blowers at 8:00 A.M.

How come Congress passed a law to make it harder for injured people to sue for negligence, but this dude and that judge can still take people to court over truly assinine complaints?
