 Post subject: just got screwed on ebay

i bought a pair of trekking poles that were supposed to be brand new, which they weren't, and they were a totally different model than the ones in the auction. they had pretty clear evidence of use and even some damage that could not have been caused by shipping. i'm pretty pissed because i've been wanting to buy some trekking poles forever, and finally broke down and bought some with my christmas cash, and now i won't have trekking poles for my trip next week.

this is the first time i've been straight up screwed by someone on ebay. i've sent the guy a couple of messages and haven't heard anything from him, so i guess its time to notify ebay.

i one time ordered cds off this guy and he wouldnt send them..

weeks went by..nothing..emailed him, nothiing

so i looked at his address..here he lived just outside baltimore..like 5 minutes away from my one buddys, who coincidentally was visiting the next upcoming weekend..

so then i emailed the dude and said he had til friday ( i sent it like sun or mon) to send my shit..i told him i was comin down..said i was goin to visit my buddy and i mapquested his house, which would take me like 5 minutes to get there..i said i wasnt gonna notify ebay or anything..just knock on his door and punch him in the face if he didnt have my shit

haha it came in the mail like 2 days later

If so, open a claim, your basis being the item wasn't as described. I know that doesn't help you for your trip but at least you get your money back.

i paid via paypal. i thought about requesting a refund, but i don't think thats a good idea, so i'll probably just leave bad feedback and file the claim with paypal.

The seller doesn't refund the money, Paypal does. If you file a claim and Paypal sides with you, then they give you your money back and then take money from the other guy. Remember that paypal has access to his credit card and/or bank account :wink: .

yes do all this thru paypal.

ebay wont do a thing, they dont give a shit if you got screwed because they already got their piece of the sale.

and feedback is ridiculous. ive left negative feedback for people and all they do is leave neg feedback to ME in retaliation

one guy took 4 weeks to ship whatever i bought with not a single email so i wrote "absolutely no comunication even after taking 4 weeks to ship" so he wrote me feedback saying "buyer is too demanding. avoid at all costs"

haha i was just checking all my feedback and i saw one neg i left for someone in 2004.

i said something like "2 weeks passed, no item no contact. scum! avoid!

so the woman responded with: "husband left me. i am not scum. will ship ur item"

you only have something like 100 characters with which to express your dissatisfaction. sometimes you have to bit the bullet and type in netspeak.

this is why i decide to go with paypal's process. i figured if i just kept the poles and left negative feedback, the seller would just give me a negative in retaliation.

i just got a response from the guy on paypal. with shipping and everything the poles cost $58. here's the guy's response:

actually it was $68 with shipping. and i'm just gonna send them back via ups and tell the guy to refund $75. i think that's pretty fair.

they're basically a fancy pair of hiking sticks that are adjustable and most have some form of suspension design inside of them. the pair i've been wanting retails for about $140 and thats what he advertised in the auction. the poles i got haven't been sold for six years according to the manufacturer. the guy is still claiming they've never been used (even though there's obvious signs of wear and dirt on them).

i'm going to send the guy a message through paypal with the ups tracking number, so everything will be on record.
