It seems they would be better off to ban Cell Phone Usage in cars,...most people smoking I've seen just have a stick between their fingers and both hands on the wheel,... a far better position than most people I see on cell phones, weaving in their lane or out of it, driving too fast or way too slow, cutting people off, not stopping when they're supposed to..... I haven't noticed smokers having as difficult a time as cell phone users.
No numbers on "smoking" related accidents in this article; I suspect/speculate, given the years and years of smoking while driving versus the relatively new introduction of cell phone technology, the number of smoking related accidents would be very very very small, if it exists at all.
Seems pretty weak legislation, who would even enforce it?

Having read your 1st sentence I'm guessing talking on mobiles while driving isn't banned in your country? It's banned in Britain, along with eating and drinking whether it be alcoholic or not, even water, and smoking while driving is legal. Madness.

On a serious note--I think they proved that the main danger with cell phones isn't having one hand tied up, it's the actual brain power that it takes to have a conversation that diverts your concentration from the road. I don't care for smoking at all, but banning people from doing it in their own cars is just asinine, unless they prove that there is a direct correlation between smokers and car accidents. On the contrary, one could argue that a nic fitting commuter would be far more detremental to the general safety of the driving population than a person using one hand to smoke. People these days...

Yes, mobiles while driving is not banned in the USA. Eating / Drinking is also not banned. Headphones are supposed to be illegal, but officers probably don't have enough resources to ticket for it; the best they can do is give a ticket for not wearing one's safety belt.

that's because it's not a federal issue. some states and wash d.c. ban cell phone use. lots of states have limited bans, e.g. bans on school bus drivers. also, at least delaware has an attentive driving law, which can prohibit cell phone use, and presumably eating and drinking as well.
as for this issue, i don't really care. people should at least have good enough manners to roll their windows down.
